Abstract
The present study aims to explain the content and semantic dimensions of “Sahih Umar ibn Hanzalah” on the subject of the general appointment of the jurist and the scope of his authority. The main issue of the research is to analyze the challenge of whether the meaning of the aforementioned narration refers exclusively to the position of judgment and consolidation or does it also have the capacity to prove political guardianship and executive leadership? Accordingly, the main question of the research is formulated as follows: “How do the semantic components and contextual evidence in the narration of Umar ibn Hanzalah indicate the assignment of both the positions of judgment and governance (execution) to the jurist?” The research hypothesis is based on the fact that despite the nature of the question in disagreement, the generality of the Imam’s (a.s.) answer, and especially the central phrase “Jalalta alaikum hakimān,” indicates the appointment of a comprehensive guardianship that includes all government affairs. This research has examined the narrative's semantic axes using a descriptive-analytical method and by using the content analysis of jurisprudential texts and historical evidence. The research findings show that first, the inflection of "Sultan" on "Qada" in the text of the narrative indicates the will of the power aggregate (execution and judgment); second, the word "Hakim" in the vocabulary and customs of the time of issuance, including "Qadi" and with the preposition "Ali", appears in political domination and guardianship. Also, the results of the research indicate that challenges such as "limiting time to the era of presence" or "the condition of consent of the parties" have been resolved by the Imam's (AS) citation analysis of the verses of the Quran and the mechanism of preference (equity and justice), and the continuation of the general appointment
